1. Agreement
These Terms of Use (“Terms”) are an agreement between you and the operator of SurePhotoID (“we”, “us”) covering the SurePhotoID iOS app and the surephotoid.com website. By installing or using the app, or using the website, you agree to these Terms. If you do not agree, do not use the app or the website.
2. License to use the app
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use SurePhotoID on Apple-branded devices that you own or control, for your own personal, non-commercial use, in accordance with these Terms and with Apple’s App Store terms (including the usage rules in Apple’s Media Services Terms and Conditions). This license does not sell you the app; we and our licensors keep all rights not expressly granted.
3. Purchases through Apple
All purchases are made through Apple’s in-app purchase system and are charged to your Apple Account. We never receive or store your payment details. The products are:
- Export Pack — $2.99. A one-time purchase that includes 5 photo exports.
- Unlimited Monthly — $4.99/month. A subscription that auto-renews until cancelled. There is no free trial.
- Lifetime — $12.99. A one-time purchase with unlimited exports, forever.
One export credit covers all re-exports of the same photo. Export Pack credits are consumable: they are stored on the device you bought them on, and neither we nor Apple can restore unused credits after the app is deleted. Lifetime and an active subscription can be restored with Restore Purchases. One-time purchases (Export Pack and Lifetime) do not renew and are charged once. Prices are shown in the App Store at the time of purchase and may vary by country and currency; the App Store price at purchase is the price that applies.
Capture, compliance checking, and preview are free — payment is required only to export.
4. Subscriptions
The Unlimited Monthly subscription automatically renews each month until you cancel it. You can cancel at any time in your Apple ID settings (on your iPhone: Settings → your name → Subscriptions), which is the only place subscriptions can be managed — deleting the app does not cancel a subscription. To avoid being charged for the next period, cancel at least 24 hours before the current period ends. After you cancel, you keep access until the end of the period you already paid for.
5. Refunds
Purchases are processed by Apple, so refund requests are reviewed and decided by Apple under its own policies — we cannot issue refunds ourselves. To request one, open the app’s Settings → Request Refund and choose the purchase, which opens Apple’s refund form, or visit reportaproblem.apple.com. Nothing in these Terms limits any refund rights you have under applicable law.
6. Compliance checking is guidance
SurePhotoID measures photos against official government specifications — head size, eye line, background color and uniformity, and sharpness — and every document template cites its official government source. This checking is best-effort guidance, not a government approval: specifications can change, some requirements cannot be measured automatically, and issuing authorities always keep discretion over what they accept. Final acceptance of any photo rests with the issuing authority. SurePhotoID is not affiliated with, or endorsed by, any government.
7. Acceptable use
You agree to use SurePhotoID only for lawful purposes. In particular, you must not:
- use the app to create photos for fraudulent, forged, or otherwise unlawful documents, or to impersonate another person;
- reverse engineer, decompile, or attempt to extract the source code of the app, except to the extent the law expressly permits it;
- circumvent or attempt to circumvent the export credit or purchase mechanisms;
- use the app or website in a way that violates any applicable law.
8. Your photos
Your photos are yours. Because all processing happens on your device, we never receive, store, or acquire any rights over your photos — no license to us is granted or needed.
9. Intellectual property
The app, the website, the SurePhotoID name and logo, and all software, design, and content we created are protected by intellectual property laws and belong to us or our licensors. Except for the license in section 2, no rights are granted to you.
10. Disclaimers
The app and website are provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be error-free or uninterrupted, or — as set out in section 6 — that any photo will be accepted by an issuing authority. Nothing in these Terms limits consumer rights that applicable law does not allow to be limited.
11. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising from or related to your use of the app or website. To the same extent, our total aggregate liability is limited to the amount you paid for SurePhotoID in the twelve months before the event giving rise to the claim. These limits do not apply where the law does not permit them.
12. Apple’s role
These Terms are between you and us — not with Apple. Apple has no obligation to provide maintenance or support for the app and is not responsible for addressing claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Purchases, subscription management, and refunds are handled by Apple as described in sections 3–5.
13. Changes
We may update the app and these Terms over time. If we change these Terms, we will post the new version on this page with an updated effective date; material changes will also be communicated in the app where reasonable. Continuing to use the app after a change takes effect means you accept the updated Terms.
14. Termination
You can stop using the app at any time; remember that deleting the app does not cancel an active subscription (see section 4). We may suspend or terminate your license if you materially breach these Terms. Sections that by their nature should survive termination (including sections 8–12) survive.
15. Governing law and severability
These Terms are governed by the laws applicable where we are established, without prejudice to any mandatory consumer protection rules of the country in which you live. If any provision of these Terms is found unenforceable, the remaining provisions stay in effect.
